TERMS AND CONDITIONS
1. INTRODUCTION
1.1 These Terms and Conditions (“Terms”) govern your use of the TURTU User Application (“Platform”) operated by TURTU India LLP (“Company”, “we”, “our”, or “us”).
1.2 By downloading, registering, or using the Platform, you agree to these Terms and to all related policies, including the Privacy Policy, Refund Policy, Cancellation Policy, and Shipping Policy.
1.3 If you do not agree with these Terms, you should not use or access the Platform.
1.4 The Company reserves the right to modify, update, or replace any part of these Terms at its sole discretion. Continued use of the Platform constitutes acceptance of such changes.
2. USER ACCOUNT AND ELIGIBILITY
2.1 To use the Platform, you must:

3. SERVICES OFFERED
3.1 TURTU is a hyperlocal delivery and commerce platform that connects Users with local vendors, restaurants, stores, and delivery partners for ordering and delivery of goods and services within city limits.
3.2 TURTU acts solely as a facilitator between Users, Vendors, and Delivery Partners and is not the seller, manufacturer, or producer of any goods or services offered on the Platform.
3.3 All orders placed through the Platform constitute a direct contract between the User and the Vendor.
4. USER OBLIGATIONS
4.1 You agree to use the Platform only for lawful purposes and in compliance with these Terms.

5. PRICING AND PAYMENTS
5.1 Prices for products and services are determined solely by the Vendor and displayed on the Platform.
5.2 TURTU facilitates payment processing via secure payment gateways and supports Cash on Delivery (COD) where applicable.
5.3 By choosing online payment, you authorize TURTU and its payment partners to collect and process payments on behalf of the Vendor.
5.4 In case of payment failure or technical issues, the Company shall not be liable for any loss until the amount settlement is confirmed by the bank or gateway.
6. DELIVERY SERVICES
6.1 Delivery Partners are independent contractors associated with the Company for logistics support.
6.2 Delivery timelines are estimated and may vary based on traffic, weather, and distance.
6.3 TURTU does not guarantee exact delivery times and shall not be liable for delays caused by circumstances beyond control.
6.4 Parcels and shipments are covered by insurance; claims for damage or loss must be raised with the Insurance Partner in accordance with the Refund Policy.
7. CANCELLATION AND REFUNDS
7.1 Cancellations and refunds are regulated by the Company’s Cancellation Policy and Refund Policy, available within the app and on the official website.
7.2 Refund processing timelines and eligibility depend on order status, Vendor acceptance, and product category.
8. INTELLECTUAL PROPERTY RIGHTS
8.1 All content, logos, designs, text, and graphics on the Platform are the exclusive property of TURTU India LLP.
8.2 No part of the Platform may be copied, reproduced, modified, distributed, or used for commercial purposes without prior written consent from the Company.
9. LIMITATION OF LIABILITY
9.1 TURTU acts as an intermediary and is not responsible for the quality, freshness, or suitability of goods sold by Vendors.
9.2 Under no circumstances shall the Company be liable for indirect, incidental, special, or consequential damages arising out of use of the Platform.
9.3 The Company’s total liability in any case shall not exceed the order value or ₹ 5,000 (whichever is lower).
10. DATA PRIVACY
10.1 TURTU collects and processes personal data in accordance with the Privacy Policy and the Digital Personal Data Protection Act, 2023.
10.2 User information is stored securely and used only for transaction processing, support, and service enhancement.
11. ACCOUNT TERMINATION
11.1 Users may deactivate their account at any time by requesting deletion through the in-app support section or via email at help.turtu@gmail.com.
11.2 TURTU reserves the right to terminate access for policy violations, fraud, or misuse of the Platform.
12. GRIEVANCE REDRESSAL
12.1 All complaints and grievances may be submitted through the in-app “Help & Support” section by raising a ticket or by emailing help.turtu@gmail.com.
12.2 Each ticket will generate a unique tracking ID for status monitoring within the app.
12.3 Grievances are acknowledged within 48 hours and resolved within 7 working days.
13. GOVERNING LAW AND DISPUTE RESOLUTION
13.1 These Terms are governed by the laws of India.
13.2 Any dispute arising under these Terms shall be referred to arbitration at Belagavi, conducted under the Arbitration and Conciliation Act, 1996.
13.3 The seat and venue of arbitration shall be Belagavi, and the courts at Belagavi shall have exclusive jurisdiction.
14. MISCELLANEOUS
14.1 If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
14.2 Failure by TURTU to enforce any right shall not constitute a waiver of that right.
